This translation is provided for convenience only. In case of discrepancies, the German version shall prevail.

§ 1 Scope, provider

(1) These terms of use apply to the use of Fomio Studio (hereinafter the "Studio"), an online configurator with which users can adapt parametric 3D printing models and download them as files (STL, 3MF).

(2) The provider of the Studio is Fomio (hereinafter the "Provider"). Full details of the Provider are given in the legal notice.

(3) The conclusion and management of subscriptions in the online shop are additionally governed by the shop's terms and conditions. Memberships on Patreon are governed by the terms of Patreon, Inc.

§ 2 Services

(1) The Studio can be used free of charge without registration. Files obtained through free use carry an embossed "Fomio.de".

(2) Registered users can save configurations as projects and view their download history.

(3) Users with an active Fomio Pro subscription in the online shop or a membership tier on Patreon enabled for this purpose ("Fomio Pro") receive files without the embossing. The entitlement exists for the duration of the subscription or membership and is checked automatically.

(4) There is no entitlement to constant availability of the Studio. The Provider may change, extend or discontinue models, functions and parameters. Files already downloaded remain unaffected.

§ 3 User account

(1) Sign-in takes place via a sign-in link sent by e-mail or via a Patreon account. One user account is permitted per person.

(2) Users must protect access to their mailbox or Patreon account against third parties and must not pass on sign-in links.

(3) Users may delete their user account in the Studio at any time. The Provider may block or delete user accounts in the event of a breach of these terms of use.

§ 4 Rights of use

(1) The models, their design and the underlying constructions are protected by copyright. Upon download, the Provider grants the user a simple, non-transferable and non-sublicensable right to use the files for private, non-commercial purposes, in particular to edit them, print them as often as required for personal use and to use the prints themselves or pass them on free of charge.

(2) Without the Provider's prior consent, it is not permitted to

(3) If the user's subscription or Patreon membership includes a commercial licence, the sale of prints is permitted to the extent described there. Passing on the files themselves remains prohibited in this case as well.

(4) Users are responsible for texts, symbols or other content they add to a model themselves. They shall ensure that they are entitled to use such content and that no third-party rights, in particular trademark rights and copyrights, are infringed.

§ 5 Obligations of the user

To ensure operation that works for all users, the Provider limits the number of requests. In particular, the following are prohibited:

§ 6 Notes on 3D printing

The files are created with the greatest care. However, the printing result depends largely on the printer, material and print settings. Before printing, users must check whether dimensions and fits are suitable for the intended purpose. The models are not intended for safety-relevant applications, as toys for children under three years of age or for contact with food.

§ 7 Liability

(1) In the case of free use, the Provider is only liable for intent and gross negligence.

(2) Otherwise, the Provider is liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health and under the Product Liability Act. In the event of a slightly negligent breach of essential contractual obligations, the fulfilment of which is a prerequisite for the proper performance of the contract and on the observance of which the user may regularly rely, liability is limited to the foreseeable damage typical for the contract. Any further liability is excluded.

§ 8 Data protection

Information on the processing of personal data can be found in the Studio's privacy policy.

§ 9 Changes to the terms of use

The Provider may amend these terms of use with effect for the future if this is necessary for objective reasons, for example due to new functions or a change in the legal situation. Registered users will be informed of material changes by e-mail at least four weeks before they take effect. If the user does not object within this period, the amended terms are deemed accepted; the notification will expressly point out this consequence. The right to delete the user account remains unaffected.

§ 10 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence.

(2) Should individual provisions of these terms of use be or become invalid, the validity of the remaining provisions remains unaffected.
